Highlights of IP Litigation Cases Handled by Our Lawyers
- Don Kelly, a registered patent attorney with over 20 years of litigation experience, has represented numerous clients in complex patent and trademark litigation. He has represented dip molding companies; packaging companies; pharmaceutical vial, telecommunications, software manufacturers and food container manufacturers in patent litigation in various jurisdictions across the country.
- Veteran IP litigator Jeffrey Kass handled several related cases for Alion Science & Technology Corp, a global company in the business of, among other things, selling flight-planning software to the military and other entities. Jeffrey obtained summary judgment and a permanent injunction in federal court against several former employees who took valuable trade secrets related to software and attempted to start a new company. He also successfully obtained a dismissal of a case brought against Alion in the City of St. Louis based on improper venue. And in a case in Chicago, Illinois, Jeffrey helped negotiate a very favorable settlement with a company who previously sold software to Alion.

The patent concerned a "double-dip" molding process for manufacturing and selling a double dip molded insulated beverage container holder. The trademark and trade dress issues involved the "look" of insulated beverage container holders.
- Jeff Hunt successfully handled a complex trademark and anti-trust case for an American and French company involving the design of massage applicators used widely in the beauty industry. On the eve of trial, defendants settled with Jeff's client and agreed to stop selling the offending devices and to destroy or relinquish similar inventory.
- Jeffrey Kass and Dan Simpson successfully fought back against allegations that a client's credit card imprinters infringed a competitor's patent.
- Jeffrey Kass played a critical role in securing victories in multiple trademark infringement cases including enforcing trademark rights in the apparel industry in Bebe v. May Company and defending trademark rights in the advertising industry in Fuse v. Fuse, both in the U.S. District Court for the Eastern District of Missouri.
